Child Benefit & Guardian’s Allowance (Administration) Regulations 2003, regulation 12

Benefit or allowance may be awarded in advance where

  • a claim is made but on the date it is made the claimant does not satisfy the entitlement conditions

and

  • Her Majesty’s Revenue & Customs is satisfied that (unless there is a change of circumstances) the claimant will become entitled on a date (the relevant date) within 3 months of the date of claim

The date of claim will be the relevant date and the benefit or allowance will beawarded accordingly, as long as the claimant satisfies the entitlement conditions when it becomes payable.

Should the entitlement conditions be found not to have been satisfied on the relevant date, the award may be revised.
