From HM Revenue & Customs · Stamp Duty Land Tax Manual

Autumn Statement 2015 announced that Higher Rates of Stamp Duty Land Tax (SDLT) would apply from 1 April 2016 to purchases of:

  • additional dwellings – such as second homes and buy-to-let properties, including the purchase of a new main residence where old main residence is still owned.

  • all dwellings by companies.

The legislation passed into law as Schedule 4ZA of Finance Act 2003, as inserted by section 128(3) of the Finance Act 2016.

Schedule 4ZA was subsequently amended by the Finance Act 2018 with effect from 22 November 2017. SDLTM09814, SDLTM09764 and SDLTM09845 cover the Finance Act 2018 changes as well as the transitional provisions in 2016.

Unless otherwise stated, all statutory references in this part of this manual are to paragraphs in Schedule 4ZA FA2003.
