Section 241 | Protected information: restriction on use or disclosure by company

(1)A company must not use or disclose protected information about any of its directors, except—

(a)for communicating with the director concerned,

(b)in order to comply with any requirement of the Companies Acts as to particulars to be sent to the registrar, or

(c)in accordance with section 244 (disclosure under court order).

(2)Subsection (1) does not prohibit any use or disclosure of protected information with the consent of the director concerned.

(3)If a company uses or discloses information in contravention of subsection (1), an offence is committed by—^F1

(a)the company, and^F1

(b)every officer of the company who is in default.^F1

(4)A person guilty of an offence under this section is liable on summary conviction—^F1

(a)in England and Wales, to a fine;^F1

(b)in Scotland or Northern Ireland, to a fine not exceeding level 5 on the standard scale and, for continued contravention, a daily default fine not exceeding one-tenth of level 5 on the standard scale.^F1
