The following only applies to barristers’ chambers schemes, not barristers’ senior clerk schemes which are concessionary, non-statutory schemes and cannot be enforced through normal paths. For more details on barristers’ senior clerk schemes, see DMBM523410.

As most chambers have no assets, if payment is not made after taking the steps outlined at DMBM523415, you should commence county court proceedings (in Scotland summary warrant and in Northern Ireland summary proceedings) unless monetary limitations indicate consideration of insolvency.

Once you have issued a county court claim form (in Scotland, a warrant and in Northern Ireland an SP summons) payment is very likely to follow because of the embarrassment and consequences of legal action against a member of the legal profession.
