The judgment summons tells the judgment debtor to pay the creditor and that the court will not accept payment. You must be alert to the possibility that judgment debtors may send payment to Banking, Shipley.

If you receive payment in full from the judgment debtor after you have requested issue of a judgment summons, tell the court office immediately.

Where the payment is by cheque and the judgment summons hearing is imminent, ask the court to adjourn the hearing to allow time for the cheque to clear. Advise the court that you will inform them as soon as the cheque clears (or otherwise). There is no fee for adjourning under these circumstances.

Where the payment is only for part of the amount on the judgment summons, you should attend the hearing and tell the judge how much has been paid (and if paid by cheque, whether it has cleared or not).
