Where the sheriff officer attempts to attach a mobile home that is the principal residence of a third party he must firstly give notice to that third party.

The third party can then apply to the sheriff, using form 11, for an order that the attachment is to cease to have effect (Rule 16(1) of the Debt Arrangement and Attachment (Scotland) Rules 2002 (SI560/2002) refers).

On receipt of such an application the sheriff clerk will fix a date for a hearing and notify both you and the third party of this.
