HCOS2500 | Registered Dealers in Controlled Oils (RDCO): civil penalties

From HM Revenue & Customs · Hydrocarbon Oils Strategy

Financial penalties can be effective in improving compliance. This section sets out RDCO law and the contraventions that attract penalties. Warning letters advising the trader of the liability to a financial penalty if they do not comply with the relevant requirement of the RDCO Regulations and the Hydrocarbon Oil and Bioblend (Private Pleasure-flying and Private Pleasure Craft)(Payment of Rebate etc.) Regulations 2008 will normally be issued before penalties are imposed but in extreme cases this may be dispensed with.

Please note that civil evasion penalties cannot be used against RDCOs as the duty point has previously been passed before reaching that part of the supply chain. Fixed civil penalties of £250 are however available for contraventions by RDCOs.

Please note that reasonable excuse must be considered in all cases involving the imposition of penalties(This content has been withheld because of exemptions in the Freedom of Information Act 2000) (This content has been withheld because of exemptions in the Freedom of Information Act 2000) .
