General

For National Minimum Wage purposes, a person can be treated as an apprentice if they are either;

  • engaged under a contract of apprenticeship (NMWM05240), or

  • a worker and participating on a government arrangement.

Government Arrangements

In England the government arrangements that can be treated as apprenticeships for National Minimum Wage purposes will take place under an English apprenticeship agreement or an alternative English apprenticeship:

In Scotland, Wales and Northern Ireland the government arrangements that can be treated as apprenticeships for National Minimum Wage purposes will take place under an apprenticeship agreement or an alternative apprenticeship approved by the relevant devolved authority.
