CCCU action on receipt of defence

When defences are received in the Bulk Centre they are reviewed and any irrelevant defences are struck out. Where the Bulk Centre processes a valid defence, it sends a copy to the CCCU.

The CCCU:

• records an action of ‘County Court - defence received’ on IDMS

• notes the date the defence was served on the CCCU

• moves the work item away from the automatic judgment in default process to C/W CCP

• changes the next action to ‘CCCU Update’ and the B/F to ‘today’

• forwards the defence to the Bradford Enforcement Unit (BEU).

Bradford Enforcement Unit action

It is the responsibility of the BEU to reply to the defence (DMBM665770).

Whatever action you wish to take ensure that you respond to the defence no later than 27 days from the date the defence was sent to the CCCU (this will reach the Bulk Centre the following day i.e. 28 days), or the claim will be stayed.

Pursuing the claim

To pursue the claim, transfer the case to the local county court (DMBM665790).

Defence is proved valid

If the defence is valid withdraw from the action using PROCEEDINGS DETAILS.

Defence sent direct to the BEU

If the defendant sends the defence direct to the BEU you must:

• use RECORD ACTIONS to note its receipt on IDMS

• forward the document to the Bulk Centre, via the CCCU under cover of the CCCU-1 stencil

• extend the B/F date by 14 days to ensure that IDMS does not apply for judgment in default before the Bulk Centre has processed the defence and served it on the CCCU.
