National Minimum Wage Act 1998, sections 45 and 45A
A prisoner does not qualify for the National Minimum Wage in respect of any work performed under prison rules. A prisoner is anyone detained in, or on temporary release from, a prison.
Similarly, a person does not qualify for the National Minimum Wage in respect of any work undertaken as a result of a work order to discharge a fine by unpaid work (under Schedule 6 of the Courts Act 2003).
